Offshore oil & gas operations
The firm mainly operates with regard to the administrative profiles of the offshore oil & gas operations subject and excels, in particular, in the knowledge and management of public procedures to obtain licences, and/or research permits or concessions for cultivation of liquid and gas hydrocarbons in the sea or unique title to be issued according to the legislative decree of 25 November 1996, no. 625, and subsequent modifications, and article 38, paragraph 5, of the decree-law dated 12 September 2014, no. 133, converted, with modifications, of the law dated 11 November 2014, no. 164.
The current legislation states that the licence can be issued, following evaluation of any competing applications, exclusively if the applicant adequately shows they possess the requisites of a general nature, technical, financial, economic and organisational capacities, and gives adequate guarantee for the plans submitted. These are incredibly important aspects and need to be constructed and proved efficiently, as the ‘suitability’ of the proof plays a crucial role in obtaining the licence.
The firm provides advice and legal assistance, also judiciary, regarding the aspects outlined above in order to obtain the licence and with regard to the matters related to it: payment of fees; any extension of the licence; transfer of licence; cases of forfeiture or withdrawal of the licence.
The firm is also highly specialised in the subject of maritime transport of dangerous goods and shipping safety, as well as in the subject of coastal deposits.
Massimiliano Grimaldi and Francesca D’Orsi were invited to participate, as experts, in the OFFSHORE MEDITERRANEAN CONFERENCE 2015 – OMC 2015 – where they gave a speech entitled “Directive 2013/30/EU on safety of offshore oil and gas operations: legal aspects and implications” in the Special Session Offshore Regulations and Technologies: 5 years after Macondo.
Massimiliano dealt with the theme of technical and operative capacity of the candidate in obtaining the licence in the light of important changes introduced by the directive EU/2013/30 on the subject of safety of operations, while Francesca analysed the changes in terms of insurance and responsibility.
